A New Jersey detective charged with fatally shooting an Anne Arundel County motorist during a road rage incident on I-97 is now facing a first degree murder charge.
Joseph Walker was previously facing a charge of second degree murder in the killing of 36-year-old Joseph Harvey Jr. in June.
Walker's attorney has said the detective did not initiate the fight and that Harvey ignored repeated warnings from Walker, who identified himself as a police officer. The attorney has said Walker's wife and children were in the van and Harvey threatened to kill the family.
Walker has been suspended from duty without pay.
