(WJLA) - In fighting Charles Severance's extradition to Virginia, defense attorney Shayne Welling has submitted a lengthy filing filled with strong opinions about the prosecution's case, calling it "flawed and questionable." He quoted John Adams and Edmund Burke on issues of truth, good, and evil.
Severance was arrested in Wheeling, West Virginia on March 13 on felony gun charges in Loudoun County. But Welling calls the warrant from Loudoun a "sham and abuse of power," arguing it was "designed solely to arrest the respondent for purposes of investigating the Alexandria homicides" of Nancy Dunning, Ron Kirby, and Ruthanne Lodato.
Welling claims detectives from Alexandria were in Wheeling shortly after the arrest was made -- but Severance has not been charged with the murders and has not even been named a suspect.
Welling claims "Alexandria created a fiction to reacquire the respondent pending the outcome of their homicide investigation," which he calls "illegal, unconscionable, and unforgivable."
Also included in the filings are search warrants for Severance's parents' home in Oakton, and Severance's address in Ashburn, where he was living with his girlfriend.
Documents show the homes were searched not in relation to gun charges, but in relation to murder charges.
