Judge rules Dave & Buster's has 30 days to leave White Flint Mall

ROCKVILLE, Md. (WJLA) -- A federal judge has ordered the popular restaurant-arcade Dave & Buster's to vacate the White Flint Mall in 30 days.

The short, two-page ruling this week by Judge Roger Titus (see below) dismissed a lawsuit by D&B Inc. against the mall's owner, Lerner Enterprises, that sought to avoid eviction.

Titus' decision, though, found that D&B had violated a geographical clause in the lease when it opened another location, deemed too close, at the Arundel Mills Mall in Hanover and he upheld the eviction.

Lerner wants to demolish White Flint and then build what it calls a "modern shopping promenade."

One other prominent mall tenant though is also fighting eviction. The Lord & Taylor department store chain still has a court appeal pending.
